What is the purpose of copyright law? Copyright law protects creative expression. The required level of creativity is low. Copyright law applies to photographs as well as to works that may be included in a photograph (such as a sculpture, a mural, a painting, etc.) Any reference to photographs also includes digital images.
How long does the copyright in a photo last? For photographs created after January 1, 1978, the copyright in a photograph is normally protected for the life of the photographer, plus 70 years.
Can I make copies of my prints or other items I purchase? No, absolutely not. Photographs are protected by U.S. Copyright laws. Copying your print in any manner (scanning, copying, etc) is a violation of Copyright Law and is not permitted.
When I purchase a print or other item with my picture on it, don’t I also own the image? No. You may own the item you purchased, but you do not own the actual image or the copyright. You only own the copyright to photos that you have taken yourself. For example, if you purchase an Ansel Adams print, you have acquired only the print, not the copyright in the image. Similarly, if you hire a photographer to make a portrait photo of your family or pets, you can purchase prints but the photographer owns the copyright in the photo. Ownership of a professional photo, be it on a print, mug, or in a photobook or slideshow, etc., does not include ownership of the copyright in the photo.
Do the rules regarding the reproduction of photos apply to digital photos and images? Yes. Copyright protects digital photos and images as well as photos made on film. Posting photos and images on the Internet does not make them free for use by others. You must be the copyright owner or have the permission of the copyright owner to use any image.
I want to purchase multiple prints. If I cannot copy them, is there a price break offered? Yes, absolutely. Please contact me for a quote! I would rather produce the prints for you to guarantee you professional quality prints! Please allow me to work with you to provide you the very best prints possible!
I want to submit a photo of my pet, or myself with my pet, to a contest or some other format. Is this possible and would it cost me anything? Yes & No. If you would like to submit your photo to a contest, a publication, newspaper, newsletter, etc, all you need to do is call or email me and ask for my permission! I will glady send the highest quality digital image file to the editor or publisher on your behalf. There is No Charge for this. I understand you're proud of your gang and your photos and you want to share them with others! And by asking permission, this gives me a chance to prepare your image just perfectly for you according to the submission requirements, as well as put a small, unobtrusive "© Jode Joyce, www.hoofnpawsimages.com" on it. This is very important to me as I grow in this business that my images are recognized.
I Want to Purchase a Digital Image File for "Personal Use". Is This Possible? Yes, I will consider each request on an individual basis. Typically photographers do not sell their high resolution digital images because they have lost the ability to control the quantity and quality of the output and they have destroyed the residual sales potential for the image. It would be like a photographer selling you their negatives, which is why the "sticker price" for these may come as a shock to some. However, there are cases where small, low resolution files may be sold. Please contact me so we can discuss your specific needs!
What Can I Do With a Digital Image File For "Personal Use"?
- You can print as many copies as you like and give them to your friends and family.

You can put the picture on your MySpace page.

You can email it to your friends.

You can post it on message boards and forums.

You CANNOT use the image to advertise your horse, farm or business.

You CANNOT publish the image in any news articles or ads. You can either ask me to send your image in for you, or if they are to be used with intent to advertise something, you need to purchase an advertising or commercial use license.

You CANNOT sell or give the image to a third party.
What Is "Commercial Use"? A Commercial Use License allows you to put your image to commercial use. If you need to use your image in any form of advertising, i.e. magazine ads, promotional brochures and flyers, or web site promotional usage, please contact me for further information. The fee for a Commercial Use License varies depending on how the image will be used...the number of and sizes of the images to be used, where they will be used (in print, on the web, on labels, etc), the length of time they will be used (how many months or years, how many times), and why they will be used (editorial, educational or commercial use).
What can I do with a Digital Image File for "Commercial or Advertising Use"?
- You may use the image to advertise your horse, farm or business in any way in print or on the web. For example: magazine ads, breeder's guides, etc.
- You may use the image on your personal or business website
- Prints can be made from CD at any photo lab.
- You can email it to your friends and clients.
- You can post it on message boards and forums.
Copyright remains the property of the photographer.
What rights do professional photographers have in their photos? Copyright law gives a professional photographer certain exclusive rights, including: * Reproducing the photograph * Preparing other images that are based on the original photograph * Distribution of copies (whether or not for sale) * Displaying the image publicy
Please Note: We photographers earn our living by creating and selling our photographs, our livelihood depends on being paid fair compensation for the images we create. Please do not use our photographs without our permission, we can and do enforce our copyrights.
